1. Определения

• "Company," "we," "our," or "us" refers to Gomsilo B.V.
• "User," "you," or "your" refers to the individual accessing or using the Services.
• "Services" refers to X-Wars Resurrection, including the website, game client, APIs, accounts, and any related applications or tools we provide.

2. Право на использование

To use the Services, you must be at least 18 years old or have reached the age of majority in your jurisdiction, have the legal capacity to enter a binding contract, and comply with these Terms and applicable laws.

3. Регистрация учетной записи

Certain features require an account, typically through a supported identity provider (such as Google or Discord). You agree to provide accurate information, keep your account details current, protect access to your account, and notify us promptly of unauthorized use.

• You are responsible for activity under your account.
• We may require invitation codes or other access controls during alpha or closed testing phases.

4. Использование Услуг

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use bots, automation, exploits, or cheats to gain unfair advantage.
• Attempt unauthorized access to the Services, other accounts, or our systems.
• Disrupt, overload, or damage the Services or other players' experience.
• Harass, abuse, or impersonate other players or staff.
• Copy, resell, or commercially exploit the Services without our written permission.

5. Виртуальные предметы и внутриигровая экономика

The Services may include virtual resources, constructions, fleets, and other in-game items. Unless we expressly state otherwise, virtual items have no real-world monetary value, are not transferable outside the game, and remain our property or that of our licensors. We may modify, balance, or remove in-game systems at any time, including during alpha development.

6. Интеллектуальная собственность

All intellectual property in the Services and our content is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial entertainment.

7. Пользовательский контент

You may submit content through the Services, such as commander names or support messages ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display User Content as needed to operate and improve the Services. You represent that you have the right to grant this license and that your User Content does not infringe third-party rights.

8. Прекращение

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you violated these Terms, pose a risk to other players, or if we discontinue the Services.

9. Отказ от гарантий

The Services are provided "as is" and "as available." Especially during alpha and early access, features may be incomplete, unstable, or changed without notice. We disclaim warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Ограничение ответственности

To the fullest extent permitted by law, Gomsilo B.V. and its directors, employees, partners, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or other intangible losses arising from your use of or inability to use the Services.

11. Возмещение убытков

You agree to indemnify and hold harmless Gomsilo B.V. and its affiliates from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services or violation of these Terms.

12. Применимое право

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Disputes shall be brought before the competent courts of the Netherlands, unless mandatory consumer protection law in your country requires otherwise.

13. Изменения настоящих Условий

We may update these Terms from time to time. Material changes will be posted on the Services. Continued use after changes take effect constitutes acceptance of the revised Terms.

14. Прочие положения

• Entire agreement: These Terms are the entire agreement between you and Gomsilo B.V. regarding the Services.
• Severability: If any provision is invalid, the remaining provisions remain in effect.
• Waiver: Failure to enforce a provision is not a waiver of future enforcement.
